I request to know how much money Nova Consultants was paid for the 953 Green solar energy project the owner of the 953 Green property is listed as Hoover Green LLC. The first is a document I previously requested and you denied: a copy of a City of Ann Arbor official document called the "Report on Sanitary Trunk Sewer System — Phase I — Audit of Existing Systems (June 1979)." This official document was provided to the state and federal governments as part of the City's process of compliance with the Clean Water Act. This document was requested under FOIA in 2014-2015 and denied on the basis that the document could be used for terrorist planning purposes. Your office signed off on the denial of a FOIA request for City of Ann Arbor sewer maps on this basis as a valid exemption under FOIA. This document was also specifically withheld during formal discovery in Yu v City of Ann Arbor in Response to Request for Documents No. 9, as follows: The City objects to the request for production of the Report on Sanitary Trunk Sewer System — Phase I — Audit of Existing Systems (June 1979) to the extent it would require the City to disclose information that the City cannot allow to be publicly disclosed for security reasons. … Without waiving or limiting its general and specific objections, the City is willing to produce the Report on Sanitary Trunk Sewer System — Phase I — Audit of Existing Systems (June 1979) to counsel for Plaintiffs if counsel for Plaintiffs enter into a non-disclosure agreement acceptable to the City to protect against public disclosure of the content of the Report that the City has determined poses a security risk if disclosed. In the alternative, the City is willing to produce without restriction a copy of the Report with the information that cannot be publicly disclosed redacted.
So, there is no question that the document exists. Kindly grant or deny the request promptly, so I can get on with the appeal this time. The request's purpose is to expose municipal corruption at City Hall.
